Welcome to QuickList.co.nz ("QuickList", "we", "our", or "us"), an online marketplace owned and operated by Catalyst Tech Solution Ltd, a New Zealand company.
These Terms of Use ("Terms") govern your access to and use of QuickList.co.nz, including our website, mobile applications (if available), APIs, messaging services, advertising services, premium features, and all related services (collectively referred to as the "Services").
QuickList provides an online marketplace where individuals and businesses may advertise, buy, sell, rent, exchange, or promote goods, services, employment opportunities, vehicles, properties, and other lawful products and services.

Transactions are entered into directly between users.

When registering an account, you agree to:

8. Marketplace Role
QuickList provides technology that allows users to connect with one another.
Unless expressly stated otherwise:

We do not guarantee the quality, safety, legality, or availability of goods or services.

We do not guarantee that buyers or sellers will complete transactions.

Users are responsible for conducting their own due diligence before entering into any transaction.
9. User Responsibilities
By using QuickList, you agree to:

Communicate respectfully.

Complete transactions in good faith where you have made a genuine commitment.

You must not use QuickList to engage in unlawful, fraudulent, misleading, deceptive, abusive, or harmful conduct.
10. Accuracy of Information
You are responsible for ensuring that all information you provide through QuickList is accurate, complete, and not misleading.
This includes:

Pricing.

Availability.

Photographs.
-
Vehicle information.

Property details.
-
Employment advertisements.

Contact information.
If information changes, you must update it promptly.
Deliberately misleading or deceptive listings may be removed without notice and may result in suspension or termination of your account.
11. Communications
By creating an account, you consent to receive electronic communications relating to your use of the Services.
These may include:

By publishing a listing, you represent and warrant that:
- You have the legal right to advertise, sell, lease, or promote the item or service.
- The listing is accurate, complete, and not misleading.
- All descriptions, images, videos, and other content are your own or you have permission to use them.
- Your listing complies with these Terms, our Community Guidelines, and all applicable New Zealand laws.
- The item or service is lawful to advertise and sell.
You remain solely responsible for the content and accuracy of your listings.
14. Listing Requirements
All listings must:
- Contain truthful and accurate information.
- Include a clear title.
- Be placed in the correct category.
- Accurately describe the condition of the item or service.
- Display genuine pricing where applicable.
- Use photographs that accurately represent the advertised item or service.
- Comply with applicable consumer protection laws, including the Fair Trading Act 1986.
You must not deliberately omit material information that could affect a buyer's decision.
15. Duplicate and Misleading Listings
To maintain a high-quality marketplace, you must not:
- Publish duplicate listings for the same item without permission.
- Manipulate search results by repeatedly reposting identical advertisements.
- Use misleading titles, descriptions, keywords, or images.
- Advertise unavailable products or "bait" listings intended to attract enquiries for different goods or services.
- Include false claims about pricing, availability, authenticity, warranties, or performance.
We may edit, remove, or reject listings that breach these requirements.
16. Photographs and Media
Images, videos, and other media uploaded to QuickList must:
- Accurately represent the advertised item or service.
- Be of reasonable quality.
- Not contain misleading edits.
- Not infringe the intellectual property rights of others.
- Not include offensive, obscene, or unlawful content.
You should avoid including unnecessary personal information, such as identity documents, vehicle registration certificates, or financial records, in uploaded media.
17. Pricing
Where a listing includes a price, you agree that:
- The price is genuine.
- Any applicable taxes or GST are disclosed where required.
- Additional charges are clearly identified.
- The pricing information is not misleading.
If pricing changes after publication, you should update your listing promptly.
18. Buying and Selling
QuickList provides a platform that enables buyers and sellers to communicate and enter into transactions directly.
Buyers and sellers are responsible for:
- Communicating honestly.
- Asking relevant questions before completing a transaction.
- Inspecting goods where appropriate.
- Agreeing on payment methods.
- Arranging delivery or collection.
- Complying with all applicable laws.
QuickList is not a party to transactions between users unless expressly stated otherwise.
19. Buyer Responsibilities
As a buyer, you agree to:
- Make genuine enquiries.
- Honour commitments you make to purchase, unless there is a legitimate reason not to proceed.
- Treat sellers respectfully.
- Verify the condition and suitability of goods before completing a transaction.
- Use secure payment methods where appropriate.
- Report suspected scams or fraudulent activity.
You should exercise reasonable care when purchasing goods or services from other users.
20. Seller Responsibilities
As a seller, you agree to:
- Describe goods and services accurately.
- Respond to enquiries in a timely manner where reasonably practicable.
- Honour agreed sale terms.
- Deliver goods as agreed or make them available for collection.
- Comply with all applicable legal obligations, including consumer protection requirements where applicable.
- Promptly remove listings that are no longer available.
Commercial sellers must also comply with any additional legal obligations that apply to businesses under New Zealand law.
21. Business Sellers
Business users must:
- Clearly identify themselves as businesses where required.
- Comply with all applicable consumer protection legislation.
- Honour warranties and guarantees required by law.
- Provide accurate business information.
- Ensure advertisements are not misleading or deceptive.
QuickList may request evidence confirming business identity or authority at any time.
22. Employment Listings
Employers and recruiters using QuickList must ensure that job advertisements:
- Accurately describe the role.
- Are lawful.
- Do not discriminate unlawfully.
- Clearly identify the employer or authorised recruiter where appropriate.
- Do not contain misleading salary or employment information.
Job seekers should independently verify employment opportunities before accepting offers.
QuickList does not guarantee the legitimacy of employers or applicants.
23. Property Listings
Users advertising residential or commercial property must ensure that:
- Property information is accurate.
- They have authority to advertise the property.
- Images accurately represent the property.
- Rental or sale terms are clearly described.
- Applicable legal requirements are met.
QuickList does not verify ownership of listed properties unless expressly stated.
24. Vehicle Listings
Vehicle advertisements should include accurate information about:
- Make and model.
- Year of manufacture.
- Odometer reading.
- Vehicle condition.
- Registration status (where applicable).
- Warrant of Fitness or Certificate of Fitness status, if stated.
- Known defects that could reasonably influence a purchaser's decision.
Misrepresenting the condition or history of a vehicle may result in removal of the listing and further action.
25. Prohibited Conduct
When using QuickList, you must not:
- Engage in fraud or deceptive conduct.
- Impersonate another person or organisation.
- Harass, threaten, intimidate, or abuse other users.
- Publish false or misleading information.
- Upload malicious software or harmful code.
- Attempt to gain unauthorised access to our systems.
- Circumvent security measures.
- Use automated bots or scraping tools without our written permission.
- Interfere with the operation of the platform.
- Collect personal information from other users for unauthorised purposes.
- Encourage unlawful activity.
26. Prohibited Listings
You must not advertise or promote any item or service that is unlawful or prohibited under New Zealand law or our Prohibited Items Policy.
Examples include:
- Stolen goods.
- Counterfeit products.
- Illegal drugs or controlled substances.
- Weapons where prohibited by law.
- Fraudulent financial schemes.
- Pyramid or Ponzi schemes.
- Fake identification documents.
- Copyright-infringing materials.
- Listings that facilitate illegal activity.
- Dangerous or prohibited goods restricted by applicable legislation.
We may remove prohibited listings immediately and, where appropriate, notify relevant authorities.
27. Marketplace Safety
To help maintain a safe marketplace, users should:
- Meet in safe public locations where appropriate.
- Exercise caution when sharing personal information.
- Verify the identity of the other party where practical.
- Use secure payment methods.
- Avoid making advance payments unless satisfied with the legitimacy of the transaction.
- Report suspicious behaviour using the reporting tools available on QuickList.
While we provide reporting and moderation tools, users remain responsible for exercising appropriate caution when interacting with others.
28. Listing Moderation
QuickList may review, edit, restrict, reject, suspend, or remove listings where we reasonably believe they:
- Breach these Terms.
- Violate our policies.
- Infringe intellectual property rights.
- Contain misleading information.
- Present safety risks.
- Promote unlawful activity.
- Are spam or duplicate content.
- Otherwise harm the integrity of the platform.
We are not obliged to monitor every listing before publication and reserve the right to take action at our discretion.
29. Reporting Content
If you believe that a listing, message, review, or other content breaches these Terms or applicable law, you may report it through the reporting features provided on QuickList.
When reviewing reports, we may:
- Request additional information.
- Temporarily restrict access to the content.
- Remove the content.
- Suspend or terminate the relevant account.
- Refer matters to law enforcement or other authorities where appropriate.
Submitting knowingly false or malicious reports may itself constitute a breach of these Terms.
30. Premium Services
QuickList may offer optional paid services to enhance the visibility or functionality of listings and accounts.
Premium services may include, but are not limited to:
- Featured listings
- Top placement in search results
- Homepage promotions
- Category promotions
- Business subscriptions
- Banner advertising
- Verified seller badges
- Premium business profiles
- Additional media uploads
- Other promotional services introduced from time to time
The availability, features, duration, and pricing of premium services may change without prior notice.
31. Fees and Charges
Certain Services may require payment.
Where fees apply:
- Prices will be displayed before purchase.
- Fees are stated in New Zealand Dollars (NZD) unless otherwise specified.
- Applicable Goods and Services Tax (GST), where required, will be included or clearly identified.
- Payment must be made using approved payment methods.
Failure to pay applicable fees may result in suspension or cancellation of the relevant service.
32. Payment Processing
Payments may be processed by independent third-party payment providers.
By making a payment through QuickList, you agree that:
- You are authorised to use the selected payment method.
- The payment information you provide is accurate.
- You authorise the payment provider to process the transaction.
- Additional terms imposed by the payment provider may apply.
QuickList does not store full credit or debit card details on its own servers.
33. Subscriptions
Where subscription-based services are offered:
- Subscription fees and billing intervals will be disclosed before purchase.
- Unless otherwise stated, subscriptions may automatically renew at the end of each billing period until cancelled.
- You may cancel future renewals through your account settings or by contacting customer support before the next billing date.
- Cancelling a subscription will not normally entitle you to a refund for the current billing period unless required by law.
34. Refund Policy
Unless otherwise required by New Zealand law or expressly stated by QuickList:
- Fees paid for premium listings, featured advertisements, subscriptions, promotional services, or other digital services are generally non-refundable once the service has commenced.
- Refund requests may be considered where:
- A duplicate payment was made.
- A technical fault prevented delivery of the purchased service.
- We are unable to provide the purchased service.
- A refund is required under applicable law.
Any approved refund will generally be made using the original payment method where practicable.
35. Taxes
Users are responsible for determining and complying with their own taxation obligations arising from transactions conducted through QuickList.
Business sellers are responsible for:
- Collecting GST where required.
- Issuing tax invoices where legally required.
- Maintaining appropriate financial records.
- Complying with Inland Revenue requirements.
QuickList is not responsible for calculating or reporting taxes on behalf of users unless expressly required by law.
36. Intellectual Property
All intellectual property rights in QuickList, including its website design, software, logos, branding, graphics, databases, text, source code, and other platform content (excluding user-generated content), are owned by or licensed to Catalyst Tech Solution Ltd.
These rights are protected under New Zealand and international intellectual property laws.
Except as expressly permitted, you must not:
- Copy or reproduce platform content.
- Modify or create derivative works.
- Reverse engineer software.
- Distribute platform materials.
- Sell or commercially exploit platform content.
- Remove copyright or trademark notices.
37. Trademarks
"QuickList", the QuickList logo, and associated branding are trademarks or trade names of Catalyst Tech Solution Ltd or its licensors.
Nothing in these Terms grants you permission to use our trademarks without prior written consent.
38. User-Generated Content
You retain ownership of the content you submit to QuickList, including:
- Listings
- Photographs
- Videos
- Reviews
- Messages
- Business information
- Comments
- Profile information
However, by submitting content to QuickList, you grant Catalyst Tech Solution Ltd a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to:
- Host the content.
- Store the content.
- Display the content.
- Reproduce the content.
- Adapt the content where reasonably necessary for technical purposes.
- Publish the content.
- Promote the content through QuickList services and marketing materials.
- Index and optimise the content for search functionality.
This licence continues for as long as the content remains on our platform and for a reasonable period thereafter where necessary for backups, legal compliance, or dispute resolution.
39. Content Standards
All user-generated content must:
- Be accurate.
- Be lawful.
- Respect the rights of others.
- Not be defamatory.
- Not contain hate speech or discriminatory material.
- Not infringe copyright, trademarks, or other intellectual property rights.
- Not contain malicious software or harmful code.
- Not include false endorsements or impersonation.
Users are solely responsible for the content they submit.
40. Copyright Infringement
QuickList respects intellectual property rights.
If you believe that content on QuickList infringes your copyright or other intellectual property rights, you may submit a written notice including:
- Your contact details.
- A description of the copyrighted work.
- The location of the allegedly infringing material.
- Evidence of your ownership or authority.
- A statement that you believe the use is unauthorised.
- A declaration that the information provided is accurate.
We may remove or disable access to allegedly infringing content while investigating the matter.
Submitting false or misleading infringement notices may have legal consequences.
41. Reviews and Ratings
QuickList may permit users to leave reviews or ratings.
Reviews should:
- Reflect genuine experiences.
- Be accurate and honest.
- Be respectful.
- Avoid offensive or abusive language.
- Not contain confidential information.
- Not be used for extortion or unfair commercial advantage.
We reserve the right to moderate or remove reviews that breach these Terms.
42. Feedback
Any feedback, suggestions, ideas, or recommendations you voluntarily provide regarding QuickList may be used by Catalyst Tech Solution Ltd without restriction or obligation to compensate you.
This helps us improve our Services and develop new features.
43. Advertising Content
Users are responsible for ensuring that advertisements comply with:
- Applicable New Zealand laws.
- Industry advertising standards.
- Consumer protection legislation.
- These Terms and our published policies.
QuickList reserves the right to reject or remove advertising that is unlawful, misleading, offensive, or inconsistent with the operation of the platform.
44. Promotional Campaigns
From time to time, QuickList may conduct promotions, competitions, discounts, or special offers.
Additional terms may apply to these promotions and will be published where relevant.
In the event of any inconsistency between promotional terms and these Terms of Use, the promotional terms will prevail for that specific promotion only.
45. Third-Party Services
QuickList may integrate with or provide access to third-party services such as:
- Payment processors
- Mapping services
- Courier providers
- Social media platforms
- Analytics providers
- Identity verification services
Your use of third-party services is governed by the terms and privacy policies of those providers.
Catalyst Tech Solution Ltd is not responsible for the availability, performance, or content of third-party services beyond our reasonable control.
46. Account Suspension and Restriction
QuickList may suspend, restrict, or temporarily disable your account or access to some or all of the Services where we reasonably believe that:

You have breached these Terms or any other applicable policy.

Your account has been compromised or accessed without authorisation.

Your activities present a security risk to the platform or other users.

You have engaged in fraudulent, deceptive, abusive, or unlawful conduct.

We are required to do so by law or a lawful request from a regulatory authority.
Where appropriate, we may notify you of the reasons for the suspension and provide an opportunity to respond before taking permanent action, unless doing so would compromise security, an investigation, or legal obligations.
47. Account Termination
We may permanently terminate your account where:

Serious or repeated breaches of these Terms occur.

You engage in fraud, scams, or criminal activity.

You intentionally interfere with the operation or security of QuickList.

You repeatedly publish prohibited or misleading listings.

You misuse other users' personal information.

You may also request that your account be closed at any time by contacting us or using any account closure functionality we provide.
Termination of your account does not affect rights or obligations that arose before termination, including payment obligations or legal claims.
48. Effect of Termination
Following suspension or termination, we may:

Restrict access to messaging features.

Retain information where required by law or for legitimate business purposes.

Prevent the creation of replacement accounts where appropriate.
Any provisions of these Terms that are intended to survive termination, including those relating to intellectual property, liability, indemnity, dispute resolution, and governing law, will continue to apply.
49. Fraud Prevention
QuickList is committed to maintaining a safe and trustworthy marketplace.
We may investigate activities that appear to involve:

Reverse engineering or attempting to discover confidential source code except where permitted by law.
We reserve the right to investigate suspected security incidents and take appropriate action.
51. Availability of the Services
While we aim to provide reliable Services, we do not guarantee uninterrupted or error-free operation.
The Services may occasionally be unavailable due to:

Telecommunications outages.

Goods or services advertised by users are safe, legal, genuine, or suitable.

Users are responsible for making their own enquiries before entering into any transaction.
Nothing in these Terms excludes or limits any rights that cannot be excluded under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or other applicable New Zealand legislation.
53. Limitation of Liability
To the fullest extent permitted by law, Catalyst Tech Solution Ltd will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss or damage arising out of or in connection with:

Your use of or inability to use the Services.

Transactions between users.
-
User-generated content.
-
Loss of profits, revenue, business opportunities, goodwill, or anticipated savings.

Data loss or corruption.

Service interruptions.

Third-party conduct.
Where our liability cannot legally be excluded, it will be limited to the minimum extent permitted by applicable law.
Where permitted by law, our total aggregate liability arising from any claim relating to the Services will not exceed the amount you paid to QuickList for the specific Service giving rise to the claim during the twelve (12) months immediately preceding the event giving rise to the claim.
54. Consumer Rights
Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot be excluded under New Zealand law.
Where you are acquiring goods or services for personal, domestic, or household use, you may have rights under legislation including:

Contract and Commercial Law Act 2017.
Where permitted by law, and where you acquire our Services for business purposes, you agree that the Consumer Guarantees Act 1993 may not apply to the extent allowed by that Act.
55. Indemnity
You agree to indemnify and keep indemnified Catalyst Tech Solution Ltd, its directors, officers, employees, contractors, affiliates, and agents against any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal costs) arising from or relating to:

Your violation of any law.

Your infringement of another person's intellectual property or privacy rights.

Your listings or other user-generated content.

Any dispute between you and another user.
This indemnity applies to the fullest extent permitted by law.
56. Force Majeure
Catalyst Tech Solution Ltd will not be liable for any delay or failure to perform its obligations under these Terms where the delay or failure results from events beyond our reasonable control.
